What Federal Charges Can Result from an IRS CI Investigation?

Since IRS CI does not focus solely on investigating tax-related crimes, IRS CI investigations can lead to a wide range of federal charges. This includes (but is by no means limited to):

  • Bank Secrecy Act (BSA) and Foreign Account Tax Compliance Act (FATCA) Violations – Individuals and entities can face criminal charges for offshore disclosure violations and various other statutory offenses under the BSA and FATCA.
  • Government Fraud – This includes government procurement fraud, fraud under permanent federal programs (i.e., Medicare and Medicaid fraud), and fraud under short-term federal programs (i.e., PPP and ERC fraud).
  • Mail Fraud and Wire Fraud – The federal mail fraud and wire fraud statutes are extremely broad, and they allow the DOJ to pursue charges in a wide range of circumstances.

  • Tax Evasion and Tax Fraud – IRS CI investigations can lead to criminal charges for tax evasion and tax fraud under various provisions of the Internal Revenue Code.
